Regulatory disclosures can have lots of twists and turns

Know the specifics of how to protect yourself and not your employer during a regulatory investigation.

 
When the state regulator was threatening a heightened supervision agreement that would result in a regulatory disclosure, HLBS Law instructed me there was only one option in this scenario, fight back. HLBS worked with my compliance department to launch an all-out offensive to get the regulator to back down.
My disclosures were expunged and I did not end up with a regulatory disclosure.

Facing a regulatory investigation could cost you your business. If you suspect you might be in trouble, or if you've received a letter saying there's an investigation coming, here are a few things you can do to help make sure you’re ready for what lies ahead.

1. Take a deep breath and do not panic, you will always have time to mount a defense.

2. Do not put anything in writing or speak to an agent of the regulatory body until you have consulted with a lawyer.

3. You must let your employer know immediately or in compliance with your employer’s policy of reporting investigations by regulators.

4. If you proceed on your own, get organized and make sure everything you put in writing is honest. At the end of the day, you do not want to get exposed and have it come out that you were being dishonest and hiding information. It will come out and the consequences will be bad.

5. If you are up against a deadline, ask the investigator for an extension. Do not panic write a response last minute.
